Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was held in federal custody.
In her decision, the judge noted that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
